Our Withholding Tax services

Each matter is scoped to what you need. You can instruct us on a single item below or on a wider mandate.

1

Withholding obligations review

Identifying which payments a business must withhold on under the Income Tax Ordinance 2001, with the conditions and exclusions that apply.

The Income Tax Ordinance 2001 requires tax to be withheld on many kinds of payment, each with its own conditions and exclusions. Businesses often comply on salaries but miss rent, services or commissions. We review the ledger by payment type and set out where the obligation applies and under which provision.

What's included

  • Mapping each category of payment to the relevant provision
  • Identifying payees with exemption or reduced-rate certificates
  • Highlighting payments where withholding has been missed
  • Writing a reference schedule for the accounts team
Discuss this service
2

Sales tax withholding

Advising registered buyers on withholding sales tax from suppliers under the Sales Tax Act 1990 and its rules.

Certain registered buyers must withhold part of the sales tax charged by their suppliers under the Sales Tax Act 1990 and the withholding rules. Whether a buyer is covered and which supplies are excluded is not always obvious. We advise on the obligation and how it flows into both parties' returns.

What's included

  • Determining whether the business is a withholding agent for sales tax
  • Identifying supplies and suppliers excluded from withholding
  • Depositing withheld tax and reporting it in returns
  • Issuing documentation suppliers need for their own filings
Discuss this service
3

Provincial services tax withholding

Withholding obligations under provincial sales tax on services laws for payments made to service providers.

Provincial sales tax on services laws also make certain service recipients responsible for withholding. The Sindh Revenue Board, Punjab Revenue Authority and other authorities each run their own regime. We identify where a business has these obligations and help it register, deduct and file with the right authority.

What's included

  • Reviewing services the business procures in different provinces
  • Identifying which provincial withholding obligations apply to those payments
  • Registering with the relevant provincial authority where required
  • Depositing and reporting withheld provincial tax
Discuss this service
4

Deduction and deposit procedures

Setting up the internal steps for deducting tax at the right point and depositing it within the prescribed time.

Most withholding failures come from process gaps: payments released before tax is calculated, or deductions made but deposited late. We design simple internal steps for the accounts team so tax is deducted at the right point and deposited within the prescribed time.

What's included

  • Linking tax deduction to the payment approval process
  • Setting a deposit routine for challans on time
  • Keeping payee details accurate for reporting purposes
  • Periodic internal checks on deductions and deposits
Discuss this service
5

Withholding statements

Preparing and filing periodic and annual withholding statements on IRIS, and revising them where errors are found.

Withholding agents file statements on IRIS reporting each deduction, the payee and the provision applied. The FBR matches these against deposits and payees' returns. We prepare and file statements, check them against challans first, and revise earlier ones where wrong payee details or amounts have caused mismatches.

What's included

  • Compiling deduction data in the format IRIS requires
  • Filing periodic and annual statements within the prescribed time
  • Revising statements where payee or amount errors are found
  • Matching statements to challans before submission
Discuss this service
6

Withholding certificates

Issuing certificates to payees and employees in the required form so they can claim credit for tax deducted.

Payees need certificates to claim credit for the tax deducted from them, and employees need them for their returns. Missing or incorrect certificates cause friction with suppliers and staff. We set up a process for issuing certificates in the required form and correcting them when needed.

What's included

  • Issuing certificates to suppliers, contractors and employees
  • Checking that certificate data matches filed statements
  • Responding to payee requests for missing certificates
  • Correcting and reissuing certificates that contain errors
Discuss this service
7

Withholding reconciliation

Matching ledger deductions, payment challans and statements, and correcting the discrepancies that trigger notices.

Ledger deductions, payment challans and filed statements should tell the same story, but often do not. Mismatches can lead to notices against the business and its payees. We reconcile the three sources, explain the differences and correct the records that can be corrected.

What's included

  • Matching ledger deductions against challans paid
  • Comparing challans with statements filed on IRIS
  • Tracing differences to their source transactions
  • Correcting records and documenting any remaining gaps
Discuss this service
8

Default and non-deduction notices

Defending businesses in proceedings that treat them as taxpayers in default for tax not deducted or not deposited.

A business that fails to deduct or deposit tax can be treated as a taxpayer in default and made to pay it, often with default surcharge and penalties. Notices frequently arrive years later. We review the payments in question, build the defence from the records and represent the business at hearing and on appeal.

What's included

  • Testing whether the payment fell within the provision cited
  • Gathering payee exemption certificates and evidence of tax paid
  • Written replies and hearings before the assessing officer
  • Appeals before the Commissioner Inland Revenue (Appeals) and ATIR
Discuss this service
9

Claiming tax withheld from you

Tracing deductions made by customers, banks and employers so they are credited in the taxpayer's own return.

Tax deducted by customers, banks and employers only helps the payee if it shows against the right NTN or CNIC and is claimed in the return. Deductions often go missing because of reporting errors. We trace each one and work with payers to correct the record.

What's included

  • Comparing certificates held with deductions visible on IRIS
  • Identifying deductions reported under the wrong number
  • Following up with payers to correct their statements
  • Claiming verified credits in the annual return

Withholding is where much of Pakistan's tax is actually collected, and it turns businesses into collectors for the FBR. A company paying salaries, rent, contractors, suppliers or professional fees will usually have to deduct tax from those payments, deposit it and report it. Get any part of that wrong and the business itself can be treated as a taxpayer in default for the amount not deducted, with further consequences.

The rules sit in several places. The Income Tax Ordinance 2001 sets out withholding on many categories of payment, each with its own conditions and exclusions. Sales tax withholding applies to certain registered buyers under the Sales Tax Act 1990 and its rules, and the provincial services tax laws have withholding regimes of their own. We map a client's payments against all of these, so the accounts team knows what to deduct and under which provision.

Monitoring is now heavily automated. Withholding statements filed on IRIS are matched against payments, deposits and the returns of payees, and gaps generate notices quickly. We reconcile deductions with deposits and statements, prepare certificates, and reply to notices alleging non-deduction or short deposit. Rates and categories change through Finance Acts and SROs, so the compliance calendar is reviewed whenever the law moves.

Questions we are often asked to resolve

  1. 1

Which of our payments require tax to be withheld, and under which provisions?

  2. 2

We missed deducting tax on some supplier payments. What exposure do we have now?

  3. 3

The FBR has issued a notice alleging non-deduction for last year. How should we respond?

  4. 4

Our withholding statements do not match the deposits shown on IRIS. How do we reconcile them?

  5. 5

Are we required to withhold sales tax on purchases from registered suppliers?

  6. 6

Tax was withheld from our receipts but is not showing against our NTN. How do we claim it?

How we help

A considered, practical approach

  1. 01

    Map the payments

We review the ledger by payment type to find every category that attracts income tax, sales tax or provincial withholding, and any exemption certificates held by payees.

  2. 02

    Set up the process

Deduction rules, deposit procedures, certificate issuance and statement filing are written into a practical checklist for the accounts team.

  3. 03

    Reconcile regularly

Deductions, challans and statements are matched against each other and against IRIS so mismatches are fixed before the FBR raises them.

  4. 04

    Answer notices

Where a notice alleges non-deduction or short deposit, we reply on the facts and the law, and appeal if an adverse order is passed.

Key considerations

What to weigh before you act

  • 1A business that fails to deduct or deposit may be held liable for the tax itself, together with default surcharge and penalties.
  • 2Exemption or reduced-rate certificates held by payees should be verified and kept on file before relying on them.
  • 3Withholding statements are cross-checked against payees' returns, so errors on one side often create problems on the other.
  • 4Income tax, federal sales tax and provincial services tax each have separate withholding rules that must be read together.
  • 5Rates and payment categories are revised through Finance Acts and SROs, so procedures need updating each year.

FAQ

Withholding Tax: common questions

Answers to the questions clients ask most often. Every matter turns on its facts.

Still have a question?

Speak with Sutra Law directly.

1Who is a withholding agent in Pakistan?

A withholding agent is any person the law requires to deduct or collect tax at source when making certain payments, typically companies, firms, government bodies and many registered businesses. The Income Tax Ordinance 2001 specifies which payers are covered for each category of payment, and sales tax law adds obligations for certain buyers. We review your payments and tell you where the obligation applies.

2What happens if a business fails to withhold tax?

The business can be treated as a taxpayer in default and made to pay the tax it should have deducted, usually with default surcharge and possibly penalties. Expenses on which tax was not withheld may also be disallowed in its own return. Much depends on the facts and on whether the payee has already paid the tax. We assess the exposure and respond to any notice issued.

3What are withholding statements and why do they matter?

They are statements filed on IRIS by withholding agents reporting the tax deducted, from whom and under which provision. The FBR uses them to match deductions against deposits and against payees' own returns. A missing or inaccurate statement can lead to notices for both the agent and the payee. We prepare and reconcile statements so the figures line up across the system.

4Can a business defend a notice for non-deduction of tax?

Often it can. Common grounds include that the payment fell outside the provision cited, that the payee held a valid exemption certificate, or that the payee has already discharged the tax in its own return. The reply needs documents, not just argument. We review the notice and the ledger, prepare a written response and represent the business in any appeal that follows.

5How do I claim credit for tax withheld from my payments?

Obtain withholding certificates from the payer, check that the deductions appear against your NTN or CNIC on IRIS, then claim them in your return. Credit may be denied where the deduction was reported under the wrong number or never deposited. Whether the tax is adjustable or final also matters. We trace missing deductions and follow up with payers to have them corrected.
