Services in detail

Our Family Law services

Each matter is scoped to what you need. You can instruct us on a single item below or on a wider mandate.

1

Court Marriage & Nikah Registration

Guidance on a lawful nikah between consenting adults, the nikahnama, the declaration before the court and registration with the union council.

Adults who choose to marry, sometimes without family approval, often ask how to do it properly. We explain what Pakistani law requires for a valid nikah, check the documents, help with the declaration of free consent and see the marriage registered with the union council under the Muslim Family Laws Ordinance 1961.

What's included

  • Confirming age, free consent and the witnesses the nikah needs
  • Checking the nikahnama entries, including dower, before signing
  • Preparing the affidavit and declaration of consent
  • Registration with the union council and certified copies

2

Khula Proceedings

Advice and representation for wives seeking dissolution of marriage through khula in the family court.

A wife who wants to end her marriage can seek khula in the family court under the Family Courts Act 1964, alongside the grounds available under the Dissolution of Muslim Marriages Act 1939. We explain privately what the process involves, including its effect on dower, then prepare the suit and represent her through reconciliation and decree.

What's included

  • Private discussion of grounds, options and the financial consequences
  • Preparing the suit with the nikahnama and supporting documents
  • Representation at pre-trial reconciliation and later hearings
  • Joining claims for maintenance or dowry articles where appropriate

3

Divorce & Talaq Formalities

Pronouncement of talaq, notice to the Union Council and the reconciliation process under the Muslim Family Laws Ordinance 1961.

Talaq carries formal requirements under the Muslim Family Laws Ordinance 1961, and mistakes can leave people unsure whether they are still married. We guide clients quietly through pronouncement, written notice to the Union Council chairman and the reconciliation stage, then help obtain the certificate confirming the divorce is effective.

What's included

  • Explaining talaq, delegated divorce and the relevant nikahnama entries
  • Drafting the talaq deed and the notice to the Union Council chairman
  • Attendance before the arbitration council where required
  • Obtaining the divorce certificate and updating official records

4

Maintenance Claims

Maintenance claims for wives and children, and the defence or variation of maintenance orders.

Where a wife or children are not being supported as the law requires, a maintenance claim can be filed in the family court. We present the household's needs and the respondent's means with evidence, and ask for interim maintenance where support is needed at once. Those facing claims they consider excessive or no longer justified can rely on us too.

What's included

  • Documenting household costs, school fees and medical needs
  • Evidence of the respondent's income, assets and lifestyle
  • Interim maintenance while the main suit is pending
  • Varying or contesting maintenance orders as circumstances change

5

Dower & Dowry Recovery

Recovering prompt or deferred dower, dowry articles and personal belongings after a marriage breaks down.

Unpaid dower and dowry articles that were never returned remain enforceable after a marriage ends. The nikahnama is the starting point for dower; for dowry, receipts, photographs and witnesses usually carry the claim. We file in the family court and follow the decree into execution, because an unpaid decree helps no one.

What's included

  • Reviewing nikahnama entries on prompt and deferred dower
  • Lists of dowry articles supported by receipts or witnesses
  • Suits for dower, dowry articles and personal belongings
  • Execution to recover the amount or articles under the decree

6

Custody & Guardianship

Custody, visitation and guardianship cases under the Guardians and Wards Act 1890, decided on the minor's welfare.

Under the Guardians and Wards Act 1890, custody turns on the welfare of the child, judged on each family's own facts. We help parents put their circumstances before the court clearly and calmly, and push for visitation arrangements that actually work. Agreement is encouraged where it serves the child; where it is not possible, we argue the case firmly.

What's included

  • Applications for custody, interim custody and appointment of guardians
  • Visitation schedules, including holidays and parents living abroad
  • Evidence on schooling, care arrangements and home environment
  • Proceedings about removing a minor or travel outside Pakistan

7

Family Court Proceedings

Suits, execution and appeals before the family courts and the forums that hear appeals from them.

Family courts follow their own procedure, built around reconciliation and quicker decisions than ordinary civil courts. We appear in the full range of family suits, from filing and pre-trial reconciliation through evidence and judgment to appeal and execution. Throughout, we keep hearings focused and protect the client's privacy as far as the process allows.

What's included

  • Filing and defending suits within the family court's exclusive jurisdiction
  • Pre-trial and post-evidence reconciliation stages
  • Appeals against family court decrees
  • Execution of decrees for maintenance, dower and custody

8

Succession Certificates

Succession certificates and letters of administration so heirs can access bank accounts, shares and other assets.

Banks, companies and other institutions will rarely release a deceased person's assets to heirs without a succession certificate or letters of administration. We prepare the application with full details of heirs and assets, deal with the public notice and any objections, and then present the certificate to each institution so the funds or shares are actually released.

What's included

  • Death certificate, family registration record and asset details
  • Filing before the competent civil court
  • Answering objections from other claimants or heirs
  • Presenting the certificate to banks and companies

9

Inheritance Matters

Working out heirs' shares under the applicable personal law and resolving disputes over the estate.

Inheritance disputes tend to arise when heirs disagree over shares, when property sits in one heir's name, or when a sister or another heir is left out. We advise on entitlement under the personal law that applied to the deceased, help families reach a written partition where they can, and go to court when they cannot.

What's included

  • Identifying legal heirs and their shares under the applicable personal law
  • Inheritance mutations and transfer of inherited property
  • Partition suits and claims by heirs denied their share
  • Family settlement deeds recording an agreed division

Overseas Pakistanis' Family Matters

Running family cases in Pakistan for clients abroad, through powers of attorney and remote coordination.

Pakistanis living abroad often need a family matter settled here without flying back for every hearing. Sutra Law acts through properly attested powers of attorney, arranges for foreign documents to be usable in Pakistan, and reports regularly by phone, email or video. We also flag early the stages where personal appearance or a recorded statement may still be required.

What's included

  • Executing and attesting a power of attorney abroad
  • Foreign marriage, divorce and birth documents prepared for use in Pakistan
  • Running the case through an authorised representative here
  • Arranging video-link or in-person appearances where needed

11

Settlement & Family Agreements

Negotiating and recording agreements on maintenance, custody, property and other family arrangements.

Many family disputes end better in agreement than in judgment, especially where children are involved. We negotiate discreetly on maintenance, custody, property and money, often with both families in the room, and write the result into clear terms that can be enforced. A well-drafted agreement also gives the parties something to return to if disagreements resurface.

What's included

  • Confidential negotiation between the parties and their families
  • Settlement deeds covering custody, visitation and support
  • Recording compromises before the family court where appropriate
  • Dividing jointly held property and personal belongings

11 areas of work

Family cases are rarely only about law. Children, money, the family home and relationships that will outlast the case are all involved. We take time to understand a client's circumstances before giving advice, and we explain the options under the Muslim Family Laws Ordinance 1961, the Dissolution of Muslim Marriages Act 1939 and the Family Courts Act 1964 in plain language, so that decisions are made calmly and with the full picture.

Our family work includes khula and talaq, with the notice and reconciliation process before the Union Council; maintenance for wives and children; recovery of dower and dowry articles; and custody and guardianship of minors under the Guardians and Wards Act 1890. After a death in the family, we help heirs obtain succession certificates or letters of administration and divide the estate according to the personal law that applied to the deceased.

A large share of our family clients live abroad. We can act on a properly attested power of attorney, gather documents from other countries and report by phone or video, so most stages go ahead without the client travelling. Agreement is encouraged whenever it is possible, especially where children are involved. When it is not, Sutra Law represents clients firmly before the family courts and appellate forums.

When clients come to us

Questions we are often asked to resolve

  2. 2

My former husband has stopped supporting our children. How do I claim maintenance?

  3. 3

My dower was never paid. Is it too late to recover it?

  4. 4

We are separating and cannot agree where the children should live. How does the court decide?

How we help

A considered, practical approach

  1. 01

    Confidential consultation

We listen first, read the nikahnama and other papers, and explain the legal position privately and without hurry.

  2. 02

    Considered options

Clients see every realistic route, from a negotiated arrangement to a contested suit, weighed against the children's welfare and long-term effects.

  3. 03

    Measured representation

In court, we keep the case focused on the issues that matter and conduct it with dignity, which judges and families both appreciate.

  4. 04

    Implementation

A decree needs follow-through. We handle execution, registration with the Union Council or NADRA where needed, and the formalities that give orders practical effect.

Key considerations

What to weigh before you act

  • 1Under the Muslim Family Laws Ordinance 1961, notice of talaq to the Union Council chairman and the reconciliation stage are part of the process. Skipping them can leave the status of the marriage in doubt.
  • 2Courts decide custody on the welfare of the particular child in the particular family. There is no formula, so the facts presented matter a great deal.
  • 3Dower, maintenance and dowry articles can often be claimed in the same family suit, which saves time and repeated hearings.
  • 4A power of attorney signed abroad usually needs proper attestation before it can be used in a Pakistani court or office.
  • 5Banks and companies normally ask for a succession certificate before releasing a deceased person's assets, even when all the heirs agree on the division.

FAQ

Family Law: common questions

Answers to the questions clients ask most often. Every matter turns on its facts.

Still have a question?

Speak with Sutra Law directly.

1What is the difference between khula and divorce in Pakistan?

Khula is dissolution of marriage at the wife's request through the family court, generally on the basis that the marriage cannot continue, and it may involve giving up or returning dower. Talaq is pronounced by the husband and must be followed by notice to the Union Council and a reconciliation process. If the nikahnama delegated the right of divorce to the wife, that is a third route. We explain which applies in your case.

2How is child custody decided?

By the welfare of the child above all. The court considers the child's age and sex, the care each parent can actually provide, the child's present home and schooling, and sometimes the child's own wishes. Visitation is usually given to the parent without custody. We help clients put the relevant facts before the court clearly and, wherever possible, reach an arrangement without a drawn-out contest.

3Can I recover maintenance for my children?

Yes. A father is generally bound to maintain his children, and if he does not, a claim can be filed in the family court. The court weighs the children's needs against the father's means, and interim maintenance can be requested while the case is pending. We build the claim around evidence of school fees, medical costs and household expenses, and of the father's income.

4I live overseas. Can my family case proceed in Pakistan without me?

Often it can. Most stages can be handled by an attorney appointed through a properly attested power of attorney, and we conduct the case on that basis. Some steps may still need your personal appearance or recorded statement, sometimes arranged by video link where the court permits. We tell you early which stages those are, so you can plan.

5How do we obtain a succession certificate?

Apply to the competent civil court with details of the deceased, the legal heirs and the assets concerned. The court publishes a notice, hears any objections and then grants the certificate. Banks and companies usually want it before they release funds or transfer shares. We prepare the application, collect the supporting documents and see it through to issue.
