Private Client

Check the title before the money moves.

We advise buyers, sellers, developers, landlords and investors across Pakistan on title checks, transactions, tenancy and property disputes. The goal is simple: clients should know exactly what they are buying, and the paperwork should hold up if it is ever tested in court.

Services in detail

Our Property & Real Estate services

Each matter is scoped to what you need. You can instruct us on a single item below or on a wider mandate.

1

Title Verification

Checking title documents and the chain of ownership against revenue, registration and authority records.

No buyer should pay for property until they know the seller holds good title and can lawfully sell. We examine the title papers and trace ownership through the revenue record, the sub-registrar's office and the relevant authority. The client then gets a plain-language report of any defects, gaps or competing claims to be cleared before completion.

What's included

  • Inspection of fard, mutation, registry and allotment records
  • Tracing each transfer to find breaks in the chain of title
  • Verifying the identity and authority of sellers and attorneys
  • A written title report listing defects and how to cure them

2

Property Due Diligence

Wider checks on approvals, encumbrances, litigation, dues and planning status for purchases and investments.

For larger purchases and investments, title is only part of the picture. We also look at approvals, mortgages and liens, pending litigation, unpaid dues and planning status. Buyers, lenders and investors can then negotiate price, conditions or protections on the basis of what they have found, rather than what they assumed.

What's included

  • Searches for mortgages, liens and pending cases affecting the property
  • Building plan approvals, land use and conversion status
  • Confirming utility, property tax and society dues
  • Reports structured for buyers, lenders or investment committees

3

Sale Agreements & Deeds

Agreements to sell, sale deeds, gift deeds and related instruments drafted with proper protections for the client.

Until title passes, the agreement to sell is the buyer's main protection; the sale deed is what completes the transfer. Sutra Law drafts and reviews both with clear payment stages, completion conditions and remedies for default. Gift deeds and related instruments for transfers within a family are prepared with the same care.

What's included

  • Agreements to sell with staged payments and completion conditions
  • Seller warranties on title, encumbrances and vacant possession
  • Sale deeds and gift deeds ready for execution and registration
  • Default, refund and forfeiture terms a court can apply without difficulty

4

Transfer & Registration

Execution, stamp duty and registration under the Registration Act 1908 and the Stamp Act 1899.

A transfer only takes legal effect when the formalities are done properly. We handle execution, stamp duty under the Stamp Act 1899 and registration under the Registration Act 1908. On the day, we check that documents, identity papers, witnesses and payments are all in order at the sub-registrar's office before anyone signs.

What's included

  • Pre-execution check of documents, identity papers and authority
  • Guidance on the applicable stamp duty and registration requirements
  • Attendance and coordination at the sub-registrar's office
  • Collecting registered documents and certified copies afterwards

5

Mutation & Record Updates

Mutations and record changes with the relevant revenue office or authority after a sale, gift or inheritance.

After a sale, gift or inheritance, the official record has to show the new owner. An out-of-date record invites disputes years later. We take clients through mutation at the revenue office or land record centre and record changes with development authorities, and we deal with objections or clerical errors that stall the process.

What's included

  • Applications for sale, gift and inheritance mutations
  • Liaison with revenue offices and land record centres
  • Correcting errors in names, areas and khasra numbers
  • Challenging wrongful or fraudulent mutations through the revenue hierarchy

6

Development Authority & Society Matters

Transfers, allotments, NOCs and disputes with development authorities and cooperative or private housing societies.

Plots and houses in development authority areas and housing societies come with their own transfer rules, approvals and dues. We handle transfers, allotments and NOCs, check whether a scheme actually holds the approvals it claims, and represent members in disputes with societies over cancellation, possession or unexplained charges.

What's included

  • Transfer applications, NOCs and allotment documents
  • Checking a scheme's approvals and the society's own records
  • Disputes over cancelled memberships, plots or allotments
  • Challenges to unexplained demands and delayed possession

7

Tenancy & Lease Agreements

Residential and commercial leases, and advice to landlords and tenants on rent, defaults and termination.

A properly drafted lease keeps many disputes away from the rent controller. Our residential and commercial leases deal with rent, security deposit, maintenance, renewal and termination in terms both sides can follow. When defaults, unauthorised subletting or arguments over handover arise, we advise landlords and tenants on where they stand.

What's included

  • Commercial leases covering fit-out, permitted use and renewal
  • Residential tenancy agreements with clear deposit and repair terms
  • Advice on default, termination notices and recovery of premises
  • Checking leases against the applicable provincial rent law

8

Property Disputes

Litigation over title, possession, specific performance, partition, cancellation of documents and fraudulent transfers.

Property disputes in Pakistan run from contested title and illegal occupation to forged transfers and family partition. Because we also handle transactions, we understand how the paperwork is meant to work and where it usually breaks. That helps us secure interim protection quickly, build the case from official records and pursue the remedy that restores the client's rights.

What's included

  • Suits for possession, partition and declaration of title
  • Challenges to forged deeds and misused powers of attorney
  • Injunctions against dispossession or onward transfer
  • Negotiated settlements between co-owners and rival claimants

9

Construction & JV Agreements

Joint venture, development and construction agreements between landowners, developers and contractors.

Projects between landowners, developers and contractors run for years and tie up serious capital, so the agreement has to plan for delay and default from day one. We draft and negotiate joint venture, development and construction contracts that allocate approvals, contributions, unit sharing and remedies clearly, and we advise when a project falls into dispute.

What's included

  • Landowner and developer agreements on unit or revenue sharing
  • Responsibility for approvals, NOCs and construction milestones
  • Construction contracts covering specifications, variations and defects liability
  • Remedies and exit routes on delay, abandonment or default

Overseas Pakistanis' Property Matters

Purchases, sales and disputes handled for clients abroad through properly attested powers of attorney.

Holding property in Pakistan while living abroad is a common source of worry, and of fraud. We handle purchases, sales and disputes for overseas clients through powers of attorney limited to the specific task, verify each transaction before money is released, and send copies of every key document so the client always knows where things stand.

What's included

  • Narrowly scoped powers of attorney that reduce the risk of misuse
  • Remote title verification and oversight of the transaction
  • Action against illegal occupation or unauthorised transfer
  • Regular written updates and document copies for clients abroad

For most families and many businesses, property is the largest purchase they will make, and the risks in Pakistan are familiar: defective title, overlapping claims, unapproved housing schemes, forged documents and transfers left half-done. Those risks are cheapest to deal with before payment. We check title against the revenue record, the sub-registrar's office and the relevant development authority or society, trace the chain of ownership, and flag anything that should be fixed or reflected in the price.

On the transactional side we handle residential, commercial and agricultural property: agreements to sell, sale deeds, gift deeds and powers of attorney under the Transfer of Property Act 1882, with stamp duty and registration under the Stamp Act 1899 and the Registration Act 1908. We also deal with mutations, transfers inside development authorities and housing societies, leases, and the agreements between landowners and developers that govern construction and joint ventures.

When things go wrong, we act in suits for specific performance, declaration, cancellation of documents, possession and partition, and in tenancy and society disputes. Drafting and litigation inform each other here. An agreement is written with an eye to how a judge would read it, and a dispute is approached with a working knowledge of how land is actually held and transferred. Overseas Pakistanis can instruct us remotely at every stage.

When clients come to us

Questions we are often asked to resolve

  1. 1

We are about to buy a plot. How do we confirm the seller really owns it and that nobody else has a claim?

  2. 2

The agreement to sell is signed, but the seller keeps postponing the transfer. What are our options?

  3. 3

Is it safe to buy in a private housing society whose approvals are unclear?

  4. 4

I live abroad and want to buy or sell property in Pakistan. How can I do this safely?

  5. 5

Our joint venture with a developer has broken down. How are the land and units divided now?

  6. 6

Our tenant is in default and the lease says little about termination. Where do we stand?

How we help

A considered, practical approach

  1. 01

    Title and due diligence

We examine title papers, official records, approvals and encumbrances, and report defects before the client pays anything.

  2. 02

    Transaction structuring

Payment stages, completion conditions and safeguards are set to suit the property and the people on the other side.

  3. 03

    Documentation and transfer

We draft the agreement and deed, attend to stamp duty and registration, and follow through with mutation and record updates.

  4. 04

    Dispute protection

If a problem surfaces, we move quickly to protect the client's position, including through an injunction and, where needed, a suit.

Key considerations

What to weigh before you act

  • 1Holding the original papers does not by itself prove ownership. The chain of title should be checked against official records before any payment is made.
  • 2Housing schemes need specific approvals from the relevant authority. Buying in an unapproved scheme can leave a purchaser with a plot that cannot be lawfully developed or transferred.
  • 3Stamp duty and registration under the Stamp Act 1899 and the Registration Act 1908 affect whether many property documents can be relied on at all.
  • 4Powers of attorney appear in a large share of property frauds. Check who signed one, what it authorises and whether it is still in force before relying on it.
  • 5A joint venture agreement should say who obtains approvals, by when, how units are shared and what happens on delay. Gaps on these points are where most JV disputes start.

FAQ

Property & Real Estate: common questions

Answers to the questions clients ask most often. Every matter turns on its facts.

Still have a question?

Speak with Sutra Law directly.

1How can I verify property title in Pakistan?

By checking the seller's documents against the official record: the revenue office or land record centre, the sub-registrar, and the development authority or housing society where relevant. That means tracing the chain of ownership, looking for mortgages, pending cases and unpaid dues, and confirming the seller's identity and authority to sell. We carry out this review and give you a written report before you commit.

2Is an agreement to sell enough to transfer ownership?

No. An agreement to sell gives the buyer contractual rights but does not transfer ownership. Title generally passes through a registered sale deed, or the transfer procedure of the authority or society concerned, followed by an update of the records. Until then, the buyer is protected mainly by the agreement itself, so its payment and completion terms need to be drafted with care.

3Can overseas Pakistanis buy or sell property without travelling?

In most cases, yes. You can appoint a trusted person in Pakistan through a power of attorney executed and attested correctly for use here, and we then handle due diligence, documents and transfer for you. We keep the power of attorney limited to the specific transaction, which reduces the risk of it being misused later.

4What should a landowner and developer joint venture agreement cover?

At minimum: what each side contributes, who obtains approvals, the construction timetable, how units or sale proceeds are shared, quality standards, and the consequences of delay or default. It should also deal with title, taxes, marketing rights and how disputes will be resolved. We draft and negotiate these agreements so each party's expectations are written down in terms a court can enforce.

5What can I do if someone has fraudulently transferred my property?

Act quickly, because every further transfer makes recovery harder. The usual remedies are a civil suit for declaration and cancellation of the forged instrument with an injunction against further dealings, and, where the facts support it, a criminal complaint for forgery. We obtain the certified records, seek interim protection and pursue whichever remedies give you the best chance of restoring your title.
