Services in detail

Our Trademark Services services

Each matter is scoped to what you need. You can instruct us on a single item below or on a wider mandate.

1

Trademark Searches

Clearance searches and a risk view on whether a proposed mark is available and registrable.

Searching before launch avoids spending on a brand that cannot be registered or that clashes with someone else's mark. We search the register for identical and similar marks, assess distinctiveness and give a practical view of the risk. Clients can then go ahead, adjust the mark or choose another with their eyes open.

What's included

  • Searches of registered and pending marks in the relevant classes
  • Phonetic, visual and conceptual similarity
  • Descriptiveness and other grounds for refusal
  • A short written opinion on availability and next steps
Discuss this service
2

Trademark Filing

Applications prepared with the correct classes and specifications of goods and services.

How an application is drafted largely decides what the registration will protect. We choose the classes and word the specifications to cover current and planned use, and advise whether to protect the word, the logo or both. The aim is a registration that is genuinely useful when it has to be enforced.

What's included

  • Classifying goods and services correctly
  • Specifications that are neither too narrow nor overreaching
  • Separate approaches for word marks, logos and series marks
  • Filing and tracking applications with the Trade Marks Registry
Discuss this service
3

Examination Responses

Written replies and hearings to deal with objections raised by the Trade Marks Registry.

Objections at examination usually concern distinctiveness or similarity to an earlier mark. Many can be overcome with the right argument. We analyse each objection, prepare a reasoned reply, add evidence of use where it helps, and attend the hearing, giving the application its best realistic chance of reaching advertisement.

What's included

  • Analysis of the examination report and cited marks
  • Written arguments on distinctiveness and differences between marks
  • Evidence of use and acquired distinctiveness where relevant
  • Representation at show-cause hearings before the Registry
Discuss this service
4

Opposition Proceedings

Bringing and defending oppositions against marks advertised in the Trade Marks Journal.

Publication in the Trade Marks Journal opens a window for third parties to oppose. Sutra Law acts for brand owners opposing conflicting applications and for applicants defending their own. We prepare notices, counter-statements and evidence, and where a coexistence agreement makes commercial sense, we negotiate one.

What's included

  • Watching the Trade Marks Journal for conflicting marks
  • Notices of opposition and counter-statements
  • Evidence affidavits on use and reputation
  • Coexistence or withdrawal arrangements
Discuss this service
5

Registration & Certificates

Taking an accepted application through to registration and issue of the certificate.

Acceptance and a quiet opposition period do not finish the job. The application still has to reach registration and the certificate has to issue. We track status, complete the remaining formalities and check the certificate against the application, so the client holds an accurate record of its rights.

What's included

  • Tracking status from acceptance to registration
  • Formalities required for issue of the certificate
  • Checking certificate details against the application
  • Portfolio records of registrations and key dates
Discuss this service
6

Trademark Renewals

Tracking and filing renewals within the prescribed time so registrations stay in force.

Miss a renewal and the registration can lapse, leaving the brand open to others. We diarise renewal dates across the client's portfolio, send reminders well in advance and file within the prescribed time. Renewal is also a good moment to confirm that owner details and specifications are still accurate.

What's included

  • A portfolio diary of upcoming renewal dates
  • Advance reminders with any documents needed
  • Renewal filings within the prescribed time
  • Restoration options where a renewal has been missed

7

Recordal of Assignments & Licences

Recording changes of ownership, licences, names and addresses on the register.

After an acquisition, a group restructuring or the grant of a licence, the register should show who owns and who may use the mark. We prepare assignment and licence documents in a form the Registry will accept, file the recordals and update names and addresses, so the right party can enforce the mark when needed.

What's included

  • Deeds of assignment with or without goodwill
  • Recording registered users and licences
  • Updating proprietor names and addresses after corporate changes
  • Recordals following mergers, acquisitions and restructuring

8

Trademark Enforcement

Cease and desist letters, negotiation and suits for infringement and passing off.

A competitor trading under the same or a confusingly similar mark takes customers and blurs the brand. Acting early matters. We assess the strength of the client's rights, collect evidence of the infringing use, and choose between a notice, negotiation or a suit for infringement and passing off depending on the facts.

What's included

  • Evidence of infringing products, packaging and advertising
  • Cease and desist letters seeking undertakings
  • Suits for infringement and passing off with interim injunctions
  • Settlements covering rebranding, stock disposal and costs

9

Domain Name Issues

Domains, handles and online listings that conflict with a registered or established mark.

Domain names, social media handles and marketplace listings are sometimes registered by others to trade on an established brand. We advise brand owners on recovering or disabling them through platform complaint procedures, domain dispute mechanisms and, when those fail, legal proceedings.

What's included

  • Identifying conflicting domains, handles and listings
  • Complaints to registrars, hosts and marketplaces
  • Domain dispute proceedings and negotiated transfers
  • Defensive domain registrations alongside trade mark filings

A name or logo becomes a business asset once it is protected. In Pakistan, trademarks are registered under the Trade Marks Ordinance 2001 through the Trade Marks Registry, which operates under IPO-Pakistan. We usually begin with a clearance search to see whether the mark is free and registrable, then agree the classes of goods and services that cover what the client sells now and plans to sell next.

After filing, the Registry examines the application and may object, typically for lack of distinctiveness or similarity to an earlier mark. We answer objections in writing and attend hearings when called. Once accepted, the mark is advertised in the Trade Marks Journal and third parties have a window to oppose. We act for applicants and opponents, and draft every step with the possibility of a later challenge in mind.

Registration is a starting point. We track renewals, record changes of owner, licensee or address, and advise on using the mark in ways that keep it strong. If a copy appears, whether on a shop shelf, a domain name or an online marketplace, we advise on notices, negotiation and proceedings. Foreign brand owners rely on Sutra Law for local filings and enforcement, often alongside their own counsel abroad.

When clients come to us

Questions we are often asked to resolve

  1. 1

We have picked a new brand name. How do we know it is free before we spend money on it?

  2. 2

Which classes should our mark be filed in to cover the business properly?

  3. 3

The Registry has objected to our application. Can the objection be overcome?

  4. 4

Someone has applied for a mark close to ours. How do we oppose it?

  5. 5

We bought a business that owns trademarks. How do we record the transfer?

  6. 6

A competitor is using a similar name and domain. What can we do?

How we help

A considered, practical approach

  1. 01

    Clearance search

We search the register and give a view on availability, distinctiveness and conflict risk before the client commits to a mark.

  2. 02

    Strategic filing

Applications go in with the right classes and carefully worded specifications, and we advise whether to file the word, the logo or both.

  3. 03

    Prosecution and opposition

We reply to examination reports, attend hearings and run or defend oppositions until the mark is registered.

  4. 04

    Portfolio maintenance

Renewal dates are diarised, ownership and licence changes recorded, and infringements dealt with as they appear.

Key considerations

What to weigh before you act

  • 1A search before launch costs far less than a forced rebrand after an earlier mark comes to light.
  • 2Protection covers only the classes and goods or services named in the registration. The specification should reflect planned products as well as current ones.
  • 3Descriptive or generic words are hard to register. An invented or distinctive mark is usually easier to protect and to enforce.
  • 4Registrations must be renewed within the prescribed time. A lapsed mark leaves room for someone else to file.
  • 5Unrecorded assignments and licences can complicate enforcement and later sales of the business, so record them promptly.

FAQ

Trademark Services: common questions

Answers to the questions clients ask most often. Every matter turns on its facts.

Still have a question?

Speak with Sutra Law directly.

1How do I register a trademark in Pakistan?

File an application with the Trade Marks Registry under IPO-Pakistan, naming the mark and the classes of goods or services. The Registry examines it, publishes it in the Trade Marks Journal for opposition and, if no opposition succeeds, registers it. We recommend running a clearance search before filing, and we handle each stage on the client's behalf.

2How long does trademark registration take?

It varies with the Registry's workload, whether objections are raised and whether anyone opposes the mark. A clean, unopposed application moves noticeably faster than one that needs written replies or goes through opposition. We cannot control the Registry's pace, but we respond promptly at each stage and keep clients told of every development.

3Can I use the TM symbol before registration?

Yes. TM simply signals that you claim the mark and can generally be used before registration. The ® symbol is different: use it only once the mark is registered, because presenting an unregistered mark as registered can carry legal consequences. We advise on labelling and packaging while an application is pending.

4What happens if someone opposes my trademark application?

You get the chance to file a counter-statement defending the application. Both sides then file evidence and the Registrar hears the matter. The result usually turns on how similar the marks and goods are, who used the mark first and the reputation each side can show. We act for applicants and opponents, and look for a coexistence settlement where that is sensible.

5Can foreign companies register trademarks in Pakistan?

Yes. A foreign company can apply in its own name and may be able to claim priority from an earlier foreign application if it files within the prescribed period. Filings and correspondence normally go through a local representative. We act for foreign brand owners on searches, filing, prosecution and enforcement, and coordinate with their counsel abroad.
